Joint Legal Custody: In Wisconsin, the court usually presumes that it is in the best interest of the child for the parents to share decision-making authority. This is referred to as legal custody. When parents have joint or shared legal custody, both parents are involved in important decisions involving the child, such as choice of school and religion, medical and treatment decisions and other major decisions. Legal custody does not refer to the day-to-day decisions. If you are awarded placement, you are entitled to make the day-to-day decisions during your periods of placement.

Physical Placement: Under Wisconsin child custody laws, the determination of the child's residence is referred to as physical placement or custody. One parent is designated as having primary placement while the other parent is granted periods of placement (child visitation). The placement schedules can vary greatly depending on many factors considered by the court. All child custody-related decisions are made according to the best interests of the child. Unless a court determines that periods of physical placement (visitation) with a parent would endanger the physical, mental or emotional health of the child, it is usually in the best interests of the child to have some periods of physical placement with each parent.

Child Support: Wisconsin child support guidelines set forth a procedure for calculating child support. The court looks at the following factors when making a child support determination: the income of both parents, the number of children being supported, the amount of time spent with the child and whether the parent is also supporting other children. Certain other factors, such as day care expenses, extracurricular activity expenses and other expenses may be cause for deviation from child support guidelines.

We strive to educate our clients about the process, their rights and their available options so that they can make informed decisions about their futures. We do our absolute best to represent, protect and advocate for our clients' interests.
